Ought v. Is

Here’s tart piece by Porter on Cass Sunstein’s vision of the Constitution. (I always enjoy Porter’s astringent writing, except for those doggone sentence fragments.)

“In the piece Cass, who was apparently given that name on purpose, takes a dim view of Scalia’s (and by extension Neil Gorsuch’s) originalist approach. Not because it fails any rational scrutiny, but because it could fail to produce liberal results.”

Well, a liberal result could be the secession of California. If accomplished the resulting melt down would be all over the liberal side. So many votes “Gone With the Wind”. Sorry, I had to toss that in.
